This past Monday, dozens of people gathered to mourn the loss of a 12 year old girl who was fatally injured in a hit and run accident the week before in Hallandale Beach. According to a report by CBS Miami, the girl’s mother organized the gathering at Foster Park that was attended by neighbors, classmates, and others in the community. The group told stories about the girl and held candles while fighting back tears.
Hallandale Beach Police state that the girl was hit when crossing Foster Avenue in front of the park last week. The car that hit the girl was located by police a short time after the accident, however the driver is still on the run.
Community members complain that this area of Foster Avenue is one common to speeders and that they, unfortunately, are not surprised that such an accident occurred. Without speed bumps or traffic signals, the road is frequently used by drivers as a cut through to Pembroke Road. The community is now lobbying local politicians to install speed bumps on the road in hopes of slowing drivers down. As one neighbor said, drivers come “flying down here like they’re on I-95.”
The girl’s mother is asking for anyone with information about the accident to come forward.
Hit and Run Accidents Are Increasingly Common in Broward County.
Hit and run accidents are unfortunately not an uncommon occurrence in Broward County as well as across all of Florida. While there is a rare instance that the driver is unaware that he or she hit someone, most of the time hit and run drivers are aware of what they have done; they are just afraid of the consequences.
The truth is, however, that most hit and run drivers are identified and located by police. Once they are found, they will face heightened criminal charges as well as civil charges from the victim or the victim’s family in the case of a fatal accident. Juries in Broward County are especially unsympathetic to hit and run drivers due to the great harm they cause as well as the indifference to their victim’s life that fleeing the scene shows.
How Can a Lawyer Help in a Hit and Run Accident Case?
An experienced Fort Lauderdale attorney can assist you in bringing charges against the party responsible for the hit and run accident. Even in cases that seem cut and dry, the law requires that certain elements be proved. Often physical evidence is the best way to do this, but physical evidence is not always going to be available. An experienced attorney knows where to look for evidence; what kind of evidence juries appreciate and understand; and how to present this evidence to the jury.
